Apple Must Face Lower Court Over App Store Commission Rate Case

Apple Inc. must take part in a lower-court proceeding over the rate it charges developers for sales outside its App Store after the US Supreme Court rejected a bid by the iPhone maker to pause all further action in the case.

Justice Elena Kagan on Thursday turned aside a request by Apple for a stay of further action by the trial court until the justices rule on an appeal related to a contempt finding in the case. The new order, which came without comment, supersedes a temporary pause Kagan imposed Wednesday to allow more time to consider Apple's request.
